1. Service Description

WeddingCircle is a digital software-as-a-service (SaaS) platform that enables wedding couples to create a private, access-controlled online photo gallery. Guests may upload photos to the gallery via a unique link or QR code provided by the couple. Gallery access is available for a defined period following a one-time purchase.

2. Accounts and Access

• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You agree to notify us immediately at kristijan@dakovic.dev if you become aware of any unauthorized use of your account.
• You agree to provide accurate, complete, and current registration information and to keep it up to date.

3. Use of Service

• Wedding couples may purchase one gallery package per wedding event for a one-time fee. The gallery is exclusively for private, personal use in connection with the stated wedding.
• Guests may upload photos to a gallery via the shareable link or QR code provided by the couple. No account or registration is required for guests.
• You must be at least 18 years old to purchase the Service.

4. User Content

• You retain full ownership of all photos and content you upload to WeddingCircle.
• By uploading content, you grant us a limited, non-exclusive, royalty-free, worldwide license to store, process, and serve that content solely for the purpose of providing the gallery service. This license terminates when the content is deleted.
• You represent and warrant that you own, or have obtained all necessary rights and permissions to upload, the content you submit, and that doing so does not infringe any third-party intellectual property, privacy, or other rights.

You agree not to upload:

• Content that is illegal under applicable law
• Content that infringes third-party intellectual property rights, including copyrighted photographs you do not own or have a license to share
• Pornographic, hateful, abusive, harassing, or violent content
• Content that depicts or exploits minors in a harmful or inappropriate manner

We are not responsible for user-generated content. We reserve the right to remove any content that violates these Terms without prior notice and without liability.

5. Service Duration and Expiration

• The service period begins at the moment payment is confirmed and the gallery is activated.
• Basic Package — provides 6 months of gallery access from the activation date.
• Premium Package — provides 12 months of gallery access from the activation date.
• Upon expiration, gallery access ends automatically. You will no longer be able to view, download, or share the gallery.
• All uploaded content and associated account data are permanently and irreversibly deleted within 7 days of expiration. We strongly recommend downloading all photos before the expiration date.
• We are not liable for any content that cannot be recovered after expiration. It is your sole responsibility to download and safeguard your content before the end of the service period.

6. Payments

• All purchases are one-time payments. There are no subscriptions, recurring charges, or automatic renewals.
• Payments are processed by Stripe, Inc. (stripe.com). We do not store or have access to your payment card details.
• Your gallery is activated immediately upon receipt of payment confirmation from Stripe.
• Prices are displayed in EUR. Stripe handles any applicable currency conversion.

7. Refund Policy

ALL PURCHASES ARE FINAL. We do not provide refunds under any ordinary circumstances.

• Under EU consumer law (Directive 2011/83/EU), consumers normally have a 14-day right of withdrawal for online digital purchases.
• By completing your purchase, you expressly request that we begin providing the Service immediately upon payment confirmation. You acknowledge and agree that, once the Service has been activated (your gallery created and made accessible), you waive your right of withdrawal in accordance with Article 16(m) of Directive 2011/83/EU.
• The sole exception to this no-refund policy is a proven technical error caused solely by the platform that prevents delivery of the Service — for example, if payment is confirmed by Stripe but no gallery is created.
• Refund requests under the technical-error exception must be submitted to kristijan@dakovic.dev within 14 days of the confirmed payment, with supporting documentation. We will review and respond within 14 days of receiving your request.

8. Limitation of Liability

• The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
• We do not guarantee that the Service will be uninterrupted, error-free, or permanently available. Scheduled or unscheduled downtime may occur.

To the maximum extent permitted by applicable law, we are not liable for:

• Loss of uploaded content due to package expiration or technical failure
• Service downtime, outages, or interruptions
• Failures of third-party providers, including Stripe (payments), Cloudflare R2 (storage), Vercel (hosting), or Railway (database)
• Indirect, incidental, special, consequential, or punitive damages arising from your use of the Service

In all cases, our total aggregate liability to you shall not exceed the amount you paid for your package.

9. Acceptable Use

In addition to the content restrictions in Section 4, you agree not to:

• Use the Service for any purpose that is unlawful or prohibited by these Terms
• Attempt to gain unauthorized access to any portion of the Service, other user accounts, or our infrastructure
• Transmit viruses, malware, or any other malicious code
• Scrape, copy, or systematically download content from the Service
• Interfere with or disrupt the integrity or performance of the Service

10. Third-Party Services

The Service relies on the following third-party providers: Stripe (payment processing), Cloudflare R2 (object storage), Vercel (application hosting), and Railway (database hosting). These providers operate under their own terms of service and privacy policies, which apply independently of these Terms. We are not responsible for the availability, practices, or performance of any third-party service.

11. Termination

• We reserve the right to suspend or permanently terminate your access to the Service at any time, with immediate effect, if you violate these Terms. No refund will be provided in the event of termination for cause.
• The Service terminates automatically at the end of the purchased package period.
• Upon termination (whether for cause or by expiration), your access is immediately revoked and all associated content and account data will be deleted in accordance with Section 7 of our Privacy Policy.

12. Governing Law

• These Terms are governed by and construed in accordance with the laws of the Republic of Croatia, without regard to its conflict-of-law provisions.
• Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of the Republic of Croatia.
• Nothing in these Terms limits or excludes any mandatory rights that apply to consumers under the laws of their country of residence within the European Union.

13. Changes to Terms

We may modify these Terms at any time. The updated Terms will be published at this URL with a revised effective date. Your continued use of the Service after the effective date of any modification constitutes acceptance of the updated Terms. For material changes, we will endeavour to notify registered users by email.
